GrowthWave secures and manages service contracts across multiple disciplines and partners with qualified subcontractors and staffing businesses to execute contracted work. GrowthWave operates as a prime contract holder and does not guarantee the availability of work orders in any specific region or service discipline.
3. Partner Relationships
3.1 Subcontract Partners
Businesses that enter into a subcontract relationship with GrowthWave agree to execute work orders under the terms of GrowthWave's prime contracts. All subcontract arrangements require a fully executed written subcontract agreement prior to the commencement of any work.
3.2 Staff Leasing Partners
Businesses that enter into a staff leasing arrangement with GrowthWave agree to place their employees with GrowthWave under a written staffing agreement. GrowthWave assumes responsibility for scheduling and deployment of leased staff under the terms of the executed agreement.
3.3 No Guarantee of Work
Submission of a partner application does not guarantee approval, work order assignment, or any ongoing business relationship with GrowthWave. All partnership arrangements are subject to GrowthWave's review, approval, and the availability of applicable contracts.
3.4 Independent Contractor Status
Subcontract partners are independent contractors and are not employees of GrowthWave Business Solutions LLC. Nothing in these Terms and Conditions or any subcontract agreement shall be construed to create an employer-employee relationship between GrowthWave and any subcontract partner or its employees.
4. Website Use
4.1 Permitted Use
You may use the GrowthWave website for lawful purposes only. You agree not to use the website in any way that violates applicable federal, state, or local laws or regulations.
4.2 Intellectual Property
All content on the GrowthWave website including text, graphics, logos, images, and data compilations is the property of GrowthWave Business Solutions LLC and is protected by applicable intellectual property laws. 6. Communications & AI Assistant
6.1 Automated Communications
GrowthWave uses automated systems including AI-powered voice and chat assistants to handle initial partner inquiries. By contacting GrowthWave via phone or web form you consent to interaction with automated systems as part of the initial intake process.
6.2 Text Messaging
By providing your phone number to GrowthWave you consent to receive text messages related to your partner inquiry or application. Message and data rates may apply. You may opt out at any time by replying STOP to any text message received from GrowthWave.
6.3 Call Recording
Calls to GrowthWave may be recorded for quality assurance and training purposes. By calling GrowthWave you consent to the recording of your call.
7. Payment Terms
7.1 Partner Payment Accounts
All payment arrangements between GrowthWave and its partners are governed by the terms of the applicable subcontract or staffing agreement. Payment terms, rates, and schedules will be established in writing prior to the commencement of any work.
7.2 No Advance Payments
GrowthWave does not collect fees, deposits, or advance payments from partner applicants at any stage of the application or onboarding process. If you are asked to pay a fee to become a GrowthWave partner please contact us immediately at [email protected].
8. Limitation of Liability
To the fullest extent permitted by applicable law, GrowthWave Business Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this website, submission of a partner application, or any business relationship with GrowthWave. GrowthWave's total liability for any claim arising under these Terms and Conditions shall not exceed the total amount paid by you to GrowthWave in the three months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless GrowthWave Business Solutions LLC, its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of this website, your partner application, or any breach of these Terms and Conditions.

If negotiation fails, the parties agree to pursue mediation before initiating any legal proceedings.
